General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between Arash Motlagh (sole proprietor) – hereinafter referred to as "Seller" – and the customers – hereinafter referred to as "Customer" – for the sale of printed T-shirts via the online shop based on Shopify. The version valid at the time of the order shall apply.

2. Contracting parties, conclusion of contract

(1) The products displayed in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.
 (2) By clicking the “Buy now” button, the customer submits a binding offer to conclude a purchase agreement.
(3) The contract is concluded as soon as the seller accepts the order by sending an order confirmation via e-mail or begins to execute the order.

3. Print-on-demand / custom production

(1) The T-shirts offered are produced exclusively on demand (print-on-demand).
 (2) The production and shipping service provider is Printful Inc., acting on behalf of the seller.
 (3) Minor variations in color, position or size of the print are possible due to production processes and do not constitute a defect.

4. Prices and sales tax

(1) All prices are final prices in accordance with Section 19 of the German VAT Act (small business regulation). No VAT is shown.
 (2) Shipping costs will be shown separately during the order process.

5. Payment methods

The following payment methods are available:

  • PayPal

  • credit card

  • Klarna

  • Apple Pay

  • Google Pay

The charge is processed immediately after the contract is concluded.

6th delivery

(1) Delivery is made worldwide to the delivery address specified by the customer.
 (2) Delivery times are non-binding guidelines, as the goods are individually manufactured.
 (3) Partial deliveries are permitted, provided they are reasonable for the customer.

7. Retention of title

The goods remain the property of the seller until full payment has been received.

8. Right of withdrawal

No right of withdrawal

Since all T-shirts are only produced after an order is placed, returns are not accepted.

9. Warranty

(1) The statutory warranty rights apply.
 (2) Obvious defects must be reported to the seller immediately, at the latest within 7 days of receipt of the goods.
(3) In the case of justified defects, the seller shall, at his discretion, either repair or replace the goods.

10. Liability

(1) The seller shall be liable without limitation in cases of intent and gross negligence.
 (2) In cases of simple negligence, the seller shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable damages typical for this type of contract.
 (3) Liability for damages resulting from injury to life, body or health remains unaffected.

11. Copyright and usage rights

(1) All designs, motifs and content of the shop originate exclusively from the seller.
 (2) Any use, reproduction or distribution without express written consent is prohibited.

12. Dispute Resolution

The seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

14. Place of jurisdiction

If the customer is a merchant or has no general place of jurisdiction in the EU, the place of jurisdiction is the seller's place of business.

15. Severability Clause

Should individual provisions of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
